Brian S. Fischer focuses his practice in the representation of businesses in Workers’ Compensation Premium Disputes, Audits, Stop Work Orders, Large Deductible and Insurance Captive Disputes, and in a variety of other employment and labor law issues. Mr. Fischer has a diverse background, which includes all aspects of the interrelationship between employers, employee leasing companies, employee staffing companies, workers’ compensation insurance carriers and the workers’ compensation system. As a practicing attorney Mr. Fischer has focused his practice in the area of Workers Compensation since 1987.
Mr. Fischer has frequently represented businesses through the Florida Department of Financial Services Stop Work Order Process including the appeal of disputed penalties through the Florida Department of Administrative Hearings. Mr. Fischer has also represented businesses, both large and small, involved in workers’ compensation premium and audit disputes through the NCCI Administered Dispute Resolution Process, and is well versed in classification code disputes, application of experience modification rate disputes and disputes involving interpretation of the NCCI Basic Manual. In addition, Mr. Fischer has also represented businesses appealing adverse decisions of the Florida Workers Compensation Appeals Board to the Florida Office of Insurance Regulation.
Mr. Fischer has represented numerous contractors in various industry trades and is well versed in the nuances of the workers’ compensation compliance requirements. He is a long standing member of the Florida Department of Financial Services Workers Compensation Fraud Task Force and has previously served as General Counsel of a multi-state workers compensation carrier and head of its Claim Department.
Mr. Fischer earned his Bachelor of Science from Florida State University in 1984 and his Juris Doctorate in 1987 from Shepard Broad Law Center at Nova Southeastern University. He is admitted to practice in the State of Florida and the U.S. District Court, Southern District of Florida.
